Buy America / BABA Frequently Asked Questions (FAQ)
1. What is the Build America, Buy America Act (BABA)?
The Build America, Buy America Act (BABA) is part of the Infrastructure Investment and Jobs Act (IIJA), signed into law in 2021. It requires federally funded infrastructure projects to use iron, steel, manufactured products, and construction materials that are produced in the United States.

2. Does Buy America apply to all projects?
No. BABA requirements apply only to projects funded in whole or in part with federal financial assistance for infrastructure. This includes projects such as roads, bridges, public transit, water systems, utilities, broadband, EV charging, and more. Each project must be reviewed individually to confirm applicability.
3. How does ANP Lighting handle Buy America compliance?
ANP reviews compliance on a project-by-project basis. We work with specifiers, contractors, and distributors to evaluate project requirements and determine whether our products can be provided in compliance with BABA. When applicable, ANP issues a formal compliance letter.
4. What products are covered under BABA?
- Iron and Steel – All manufacturing processes must take place in the U.S.
- Manufactured Products – Must be produced in the U.S. with a majority of domestic components.
- Construction Materials – Must be produced in the U.S.
5. Are there exceptions or waivers?
Yes. Federal agencies like the EPA can issue waivers in three situations:
- Public Interest Waiver – if applying BABA is contrary to public interest.
- Non-Availability Waiver – if products are not available in sufficient quantity or quality in the U.S.
- Unreasonable Cost Waiver – if using U.S. products raises project cost by 25% or more.
6. Does ANP manufacture products in the United States?
Yes. ANP Lighting has a long history of U.S. manufacturing. Our luminaires are designed, engineered, and produced at our California facility, supporting American jobs and craftsmanship.
7. Can ANP provide a compliance letter for my project?
Yes. If your project requires Buy America compliance, ANP can provide a project-specific compliance letter upon review of the project details.
8. What information does ANP need to issue a compliance letter?
Please provide:
- Project name and location
- Scope of work and fixture types required
- Funding source (confirming federal involvement)
- Timeline and submittal requirements
